Trump Speeds Up Federal Approval for Data Center Infrastructure Construction - President Donald J. Trump

In a bid to bolster America’s leadership in AI and manufacturing, President Donald J. Trump signed an Executive Order titled "Accelerating Federal Permitting of Data Center Infrastructure" on July 23, 2025. The order aims to speed up the construction of AI data centers and supporting infrastructure, critical to national security and economic prosperity.

The order focuses on streamlining and expediting federal permitting processes, with agencies directed to expedite permitting for data centers and related energy projects. This is achieved by streamlining reviews under the Clean Water Act (CWA), Clean Air Act (CAA), and the National Environmental Policy Act (NEPA). The FAST-41 process is used to track and speed up permitting.

The order defines "Qualifying Projects" as primarily data centers requiring more than 100 megawatts of new electrical load dedicated to AI data processing. This also covers infrastructure related to these centers such as semiconductor fabrication facilities and networking equipment. The order prioritizes the use of federally owned land and resources for data center development, and promotes repurposing Brownfield and Superfund sites for this purpose.

Financial support initiatives are also included, with the Secretary of Commerce tasked with launching programs to provide loans, grants, and tax incentives to qualifying projects, encouraging rapid infrastructure expansion. The order explicitly revokes a Biden-era order that imposed Diversity, Equity, and Inclusion (DEI) and climate-related requirements on federal land AI data center projects, removing those perceived regulatory burdens to accelerate development.

The Administration frames the initiative as part of a broader "golden age" for American manufacturing and technology dominance, emphasizing bold industrial strategies for national security, economic prosperity, and scientific leadership, with a priority on AI infrastructure. The order represents a comprehensive effort to reduce regulatory barriers, enhance transparency, facilitate funding, and leverage federal lands for rapid expansion of data center infrastructure critical to AI.

In 2020, President Trump took executive action to establish the first-ever guidance for Federal agency adoption of AI. In 2019, he signed the first-ever Executive Order on AI recognizing the paramount importance of American AI leadership. The Administration has also established the first-ever national AI research institutes in historic actions.

The order capitalizes on other permitting successes that will enable data center development, such as reducing NEPA's impact on critical infrastructure projects. The Department of the Interior, the Department of Energy, and the Department of Defense are directed to authorize data center construction on appropriate Federal lands. President Trump issued the world’s first AI regulatory guidance to govern AI development in the private sector.

In April 2025, President Trump signed an Executive Order to advance AI education for America’s youth, further demonstrating his commitment to AI leadership. Overall, the EO represents a significant step towards securing economic prosperity, national security, and scientific leadership through the rapid expansion of AI data centers and critical infrastructure.
