Meta Allowed to Train AI Systems with German User Data
Following a court ruling last Friday, social media giant Meta can now begin using user data from Germany to train artificial intelligence (AI) systems on Facebook and Instagram. The decision, made by the Higher Regional Court of Cologne, comes after a failed attempt by consumer protection advocates in Germany to have the use of data for AI training prohibited.
The court deemed Meta's use of user data as a legitimate pursuit without violating European Union law. The company is now authorized to use even publicly available data from German users for AI training, provided that the data could be accessed via search engines, and Meta has taken steps to minimize user impact.
Meta is only allowed to use publicly available user data and not private or restricted information. Judges emphasized the intention to use data that is already accessible online, considering Meta's measures to communicate its plans to users and offer objection procedures through its mobile apps.
Though the court ruled in favor of Meta, consumer protection organizations and some regional data protection authorities remain critical and continue to pursue actions to block or restrict Meta's AI training initiatives. For instance, the Hamburg Data Protection Commissioner has initiated urgent proceedings to prohibit Meta from using German user data for AI training for at least another three months.
Meta has improved transparency notices and made it easier for users to object to their data being used for AI training. The company must continue to inform users about these practices and provide clear opt-out mechanisms.
