Details regarding Agilisys' termination to be publicly revealed in the coming days

The States of Guernsey have announced the termination of their 10-year contract with IT services provider Agilisys this summer, marking a significant shift in the digital landscape of the Bailiwick.

The decision to terminate the contract was made with the support of law officers and external lawyers, ensuring a smooth process throughout. The States moved to a multi-company model to modernize digital public services, and multiple other companies, including C5, JT, and Apogee, have already signed contracts to deliver these services.

Policy & Resources (P&R) will publish the legal fees and legal advice they received in connection with the termination process within the coming months. In preparation for the change, P&R conducted a full analysis of the employment terms offered to Agilisys staff.

For the majority of staff, the only change was the company shareholder, and terms and conditions remained the same. A small number of new joiners to the States of Guernsey were recruited to standard terms and conditions.

The States engaged with former Agilisys staff through group sessions and one-to-one meetings to ensure a seamless transition. The contract with Agilisys ended on 31 July based on performance-related reasons.

P&R declined to comment on employment matters related to salaries, benefits, and working conditions. They also declined to publish any of the confidential briefings or detail when these were issued to senior politicians. Similar briefings have been provided to the current Committee.

The political approval to terminate the contract with Agilisys was granted by the state government, and they were first informed about the potential decline or continuation of IT service quality risks at the time of the initial contract review process. P&R stated that the former political membership of P&R, which approved the termination of the deal, was fully informed of all relevant strategic and operational considerations, including arrangements for the transition period.

Recently, P&R received a Freedom of Information (FoI) request asking for details of when they were first advised that terminating the contract could result in a decline in IT service quality or continuity, and for related documents on contingency planning. However, no details about the confidential briefings or when they were issued to senior politicians were published by P&R.

The Bailiwick invoked exemptions to the freedom of information code based on the security of the Bailiwick, protecting personal records, data protection over third party information, and to prevent harm to the frankness and candor of internal discussion.

As the States of Guernsey continue to modernize their digital services, more changes and improvements are expected in the near future.
